1. What We Do

LodgeMiLien LLC ("LodgeMiLien," "we," "us," or "our") is a document preparation service that assists Michigan contractors, subcontractors, material suppliers, and laborers in preparing mechanics lien documents pursuant to the Michigan Construction Lien Act (MCL 570.1101 et seq.).

Our services include preparation of the following documents based on information you provide:

We do not file documents on your behalf unless you have purchased the optional filing coordination add-on. We do not represent you in any legal proceeding. We do not provide legal advice.

2. We Are Not a Law Firm

LodgeMiLien is not a law firm and does not practice law. The documents we prepare and the information we provide do not constitute legal advice. No attorney-client relationship is formed by your use of this service. The information provided through this service is for general informational purposes only.

Michigan mechanics lien law involves deadlines, requirements, and procedures that vary based on the specific facts of your situation. While our documents are prepared using Michigan-statutory language, we cannot guarantee that any document we prepare will be legally sufficient for your specific circumstances.

3. Eligibility

4. Your Responsibility for Accuracy

The quality and legal sufficiency of your documents depends entirely on the accuracy of the information you provide. You are solely responsible for:

LodgeMiLien reviews documents for formatting and internal consistency but cannot independently verify the accuracy of the information you provide. We are not responsible for documents that are incorrect due to inaccurate information submitted during intake.

5. Proof of Work Requirement

All orders require upload of proof of work documentation before processing. Acceptable documentation includes signed contracts, work orders, invoices, purchase orders, or other documents evidencing the agreement between you and the property owner or general contractor.

By uploading proof of work documentation you represent that:

Submission of false or fabricated documentation in connection with a mechanics lien filing may constitute fraud and is subject to civil and criminal penalties under Michigan law. LodgeMiLien reserves the right to decline any order where submitted documentation appears fraudulent or inconsistent with the information provided.

6. Document Review and Delivery

All orders are subject to manual review before documents are released. This review is conducted to verify formatting accuracy and internal consistency. Review is typically completed within 24 hours of payment.

Documents are delivered by email to the address provided during intake. LodgeMiLien is not responsible for documents that are undeliverable due to an incorrect email address.

LodgeMiLien reserves the right to decline any order and issue a full refund if, in our sole judgment, the order cannot be processed consistent with these terms.

7. Refunds

Due to the nature of document preparation services, all sales are generally final once documents have been delivered.

8. Limitation of Liability

To the maximum extent permitted by Michigan law, LodgeMiLien LLC's total liability to you for any claim arising out of or related to your use of this service shall not exceed the amount you paid for the order giving rise to the claim.

9. Governing Law

These terms are governed by the laws of the State of Michigan without regard to conflict of law principles. Any dispute arising out of or related to these terms or your use of the service shall be brought exclusively in the state or federal courts located in Oakland County, Michigan.

10. Changes to These Terms

LodgeMiLien reserves the right to update these terms at any time. Updated terms will be posted at lodgemilien.com/terms with a new effective date. Your continued use of the service after any update constitutes acceptance of the revised terms.

Frequently Asked Questions

Can you guarantee my lien will be valid?

No. We prepare documents using Michigan-statutory language based on the information you provide. Whether a lien is ultimately valid depends on factors we cannot control, including the accuracy of your dates and property information, whether you met all statutory prerequisites, and how courts interpret the facts of your specific situation. We strongly recommend consulting a Michigan attorney if you have any doubt about your eligibility to file.

What if I missed the 20-day Notice of Furnishing deadline?

You may still have partial lien rights. The 20-day Notice of Furnishing requirement applies to subcontractors and suppliers. Missing it does not eliminate your right to file a Claim of Lien but may limit the amount you can recover to work performed after the notice was served. Tell us your dates during intake and we will flag the issue in your documents.

What if the 90-day Claim of Lien deadline has already passed?

If your 90-day window has expired, a mechanics lien is no longer available. You may still have other remedies including a breach of contract claim in Michigan district or circuit court. We cannot prepare documents for an expired lien and will decline the order with a full refund if this is the case.

Do I need an attorney to file a mechanics lien?

Michigan law does not require an attorney to file a mechanics lien. However, if you anticipate the lien will be contested, if the amount in dispute is significant, or if you need to enforce a filed lien through court action, we strongly recommend retaining a Michigan construction attorney. Can I file a lien against a government-owned property?

No. Michigan law does not permit mechanics liens against government-owned property. Public projects are governed by the Public Works Bond Act (MCL 129.201 et seq.), which requires filing a bond claim against the contractor's payment bond rather than a lien against the property. LodgeMiLien does not prepare public works bond claims.

What happens after I file the lien?

A filed lien becomes a cloud on the property title. The property cannot be sold or refinanced until the lien is resolved. Many disputes settle after a lien is filed because the property owner cannot close on a sale or obtain financing with a lien on record. If the dispute does not resolve, you may enforce the lien through a Michigan circuit court action, which must be filed within one year of the last date of furnishing. Lien enforcement requires an attorney.

What if the property owner disputes the lien?

A property owner may file a discharge of lien by posting a bond equal to 150% of the lien amount with the court. If this happens, the lien is discharged from the property but your claim transfers to the bond. You would then need to pursue that claim in court. This is another situation where a Michigan construction attorney is advisable.

Is my uploaded proof of work document kept confidential?

Your proof of work document is stored securely and used only to verify the legitimacy of your order. It is not shared with any third party except our hosting provider (Vercel) as part of normal file storage operations. It is not provided to the property owner, any court, or any government agency unless required by valid legal process. See our Privacy Policy for full details.
